Counting Cree's LED Patent Campaign

Recently, CREE held a patent battle and filed a lawsuit against the US company E. Mishan & Sons, Inc. ("Emson") in the US District Court of Massachusetts, accusing the Emson flashlight product of infringing its LED technology patents, including Bell + Howell Taclight.

“Cree will not tolerate and actively defend against this blatant disregard of its intellectual property rights.” Dave Emerson, senior vice president and general manager of Cree's LED business unit, reflects Cree's strong intellectual awareness of intellectual property. In addition to Nichia, Cree is also one of the protagonists of the LED industry patent dispute case in recent years. Let's take a look at some of the larger patent dispute cases related to Cree.

I. CREE VS Feit Electric sues: CREE is accused by Feit Electric of infringing LED patents

In July 2015, Feit Electric announced that it had filed a patent infringement lawsuit against CREE in the Central District of North Carolina. Fett Electric claims that CREE's 4FLOW LED bulbs infringe on US Patent Nos. 8408748 and 9016901.

Currently, Fett Electric is requesting a ban by the court to prevent CREE from continuing to sell 4FLOW LED bulbs while seeking damages.

Counterattack: CREE sues Feit Electric for infringing LED bulb patents

In May 2016, Cree accused Feit Electric of infringing Cree's LED-related patented technology at the Federal District of North Carolina, USA. The main infringing patent was related to LED bulbs.

The case involved Cree's two main patents, one of which is the LED bulb US Patent No. 8,998,444, titled "Solid State LighTIng Devices Including Light Mixtures", technology is in LED lighting products. Color mixing technology, and the patent of US Patent No. 9,052,067, titled "LED Lamp with High Color Rendering Index", focusing on high color rendering LED luminaire technology, also mixing color and improving LED light Technology.

Initial judgment: preliminary investigation of the 337-TA-947 investigation case, Cree was supported by ITC

CREE announced on August 2, 2016 that the company has received a preliminary ruling from the US International Trade Commission ("ITC") regarding the investigation of 337-TA-947 (some LED products and their components).

The judgement of the ITC judge is as follows:

- Infringement of US Patent No. 8596819 (LED Lighting Product Efficiency), US Patent No. 8628214 (LED Lighting Product Efficiency), US Patent No. 7976187 (All-round LED Lighting Products), US Patent No. 8766298 (LED Component Structure), Fees Special and Dongbei were found guilty of violation of Section 337 of the Tariff Act.

- Fett and Dongbei affixed the ENERGY STAR label to some products that failed to meet the ENERGY STAR standard or requirements, and the act of publishing false and misleading advertisements was ruled illegal.

The US International Trade Commission is currently expected to make a final decision on the investigation on November 29, 2016.

Second, Cree VS Hong Qi sued: Cree infringed on its six patents

Cree sued Hong Qi for infringing six patents in the West District District of Wisconsin on September 15, 2014, and is known as a white LED patent. Hong Qi said that Cree is a supplier of Hongqi. In recent years, it has purchased hundreds of millions of Taiwanese products. Since 2013, Hongqi has been actively proposing further business cooperation programs to help Cree improve its product competitiveness and seek a win-win situation. Hongqi was surprised and regretted about the patent war against customers and goodwill partners.

Counterattack: Cree is countered by Hongqi

On January 5, 2014, Hong Qi sued Cree and its affiliates in the US District Court for the Northern District of California - Hong Kong Cree and Shanghai Career Optoelectronics infringed on Hongqi's US LED patent.

Hong Qi spokesperson Zheng Jixiong said on the 7th that Hong Qi and Career had broken through the negotiations. Hong Qi believed that the Kerui Lions had a big mouth and decided to file a report on Curry in the United States. Wang Qilong, chairman of Hongqi, is the chairman of the Taiwan Optoelectronic Semiconductor Industry Association (TOSIA). Hong Qi believes that once the conditions of Cree are accepted, it will be unfavorable to Taiwan's LED factory.

Cree's Chinese patent was invalidated

Hongqi issued a press release on August 18, 2015, stating that Hongqi Technology has successfully disabled the Chinese patent (Patent No. X) of the "Devices and Methods for Mounting Electronic Components" under the name of Huizhou Cree Semiconductor Lighting.

Hongqi Technology issued a statement stating that the invalidation procedure was entrusted to Beijing Tongli Yucheng Intellectual Property Agency Co., Ltd. on December 22, 2014. The Patent Reexamination Board of the State Intellectual Property Office of China officially announced the patent on July 26, 2015. The rights are all invalid.

Hong Qi sued Cree for infringement

On January 26, 2016, Hong Qi entrusted the US law firm Devlin Law Firm LLC to sue CREE for a patent in the US District Court for the Central District of California. The white LED related patent number is US 6 , 841,934. This time, Hongqi Technology once again filed a lawsuit in the United States, which is related to LED packaging.

Settlement: Hong Qi and Cree reconcile all patent litigation

On April 29, 2015, Hongqi and CREE reached a patent settlement agreement, and both parties revoked all patent litigation. According to the major information released by Hongqi, this agreement contains all patent litigations of both parties, and Hongqi pays royalties to obtain non-exclusive licenses. The royalties include one-time fees and annual rights; the content of the settlement agreement is confidential.

Third, Cree VS SemiLEDs

In July 2012, Cree said that it agreed to end the patent infringement lawsuit between the two parties with SemiLEDs. As part of the settlement, SemiLEDs agreed to a ban effective on October 1, 2012, to stop importing and selling defendant products to the United States, and to pay Cree a fee to compensate for the loss. The remaining terms of negotiation between the parties have been lifted and the other terms of the negotiations are confidential.

Cree VS Cooper

Cree filed a patent infringement lawsuit against the Federal District of Wisconsin Eastern District on February 19, 2013, accusing Cooper LighTIng, LLC, which manufactures and sells LED lighting equipment, to manufacture a number of LED lighting products sold, especially with Cooper. Among the AccuLED OpTIcs light-guide system, the regional lighting, street lighting and other LED lighting products infringe Cree's patent rights of US Patent No. US 8,282,239, and one of the regional/street lighting products named Ventus LED , infringes on US patent US 8,070,306 owned by Cree.
